Izwe.com (the "website", the "izwe service", the "izwe platform") is provided by Izwe Limited (Company no. 06721656), hereafter referred to as "izwe" (because we like it more).
Our offices are based: 47-49 Pitfield Street, London, N1 6DA
Use of the website and services are governed by these terms and conditions (“terms”). By using the website and its services then you agree to be legally bound by these terms. This includes signing up to be an izwe user (and ticking you agree to them – yes that does actually mean something), taking part in an izwe activity or by simply accessing the website.
In addition all users must abide by our Community Guidelines to make the website a nicer place. You also need to agree to our Privacy Policy and Abuse Process.
We may update our terms from time to time and we will try to let you know through other means but it's always worth coming back and checking to see if any revisions have been made. By continuing to use the website after we have posted new terms you are considered to have consented to them.
All of our terms are created through common sense and web norms so hopefully there's nothing you wouldn't expect in there.

You & izwe
To use many of the izwe services you need to create an account or profile on the website.
You are responsible for ensuring that the security details (i.e. your username and password) associated with this profile remain secure and we are entitled to assume that any use of your security details is by you or with your consent. You are responsible for all such use.
Security details are provided at registration and can be edited through the tools izwe provides. We recommend changing passwords regularly and using different passwords for your accounts across your different online services (for tips on creating good passwords see this useful article by BBC Click tech expert Rob Freeman: Choosing a good password).
Providing complete, current and accurate personal information will make your participation in the izwe service more credible and allows us to have an accurate idea of what's going on (something that's very useful when planning improvements to the site). We provide tools to update any personal information to allow it to remain current. This means you must not impersonate anyone else, nor are you allowed more than one account.
Your privacy
We do collect and use data about how you and other viewers browse our sites and view our content. Certain parts of our site may require you to identify yourself. Please review our Privacy Policy for further details.
If you do not wish to be known on the izwe platform by your real name, every profile can create a display name.

Permission to use the Izwe Services
We want you to use our services to the full. But there are limits. Our Community Guidelines apply at all times. Without our prior written consent, you may not use or attempt:
- to use the izwe services for any commercial purpose (so no trying to sell things please)
- to use any systemic method to copy our content in to any other form or structure
- to copy any of our content for the purposes of republishing it
- to modify or adapt or derive other works from our content
- to scan, spider or index our content in violation of our robots.txt directives
- to scan, spider or index our content in a manner inconsistent with good industry practice or so as to place an unreasonable burden or load on the webservers and other technical infrastructure from which our systems are operated (even if permitted by our robots.txt directives)
When we talk about about ‘our content’ we mean any content that is on the izwe platform.izwe has the right (but doesn't want to have to use it) to suspend or terminate your account if any of these terms or our community guidelines are breached.

Content and Intellectual Property in Content that You provide
“Content” on the website refers to any text, images, photos, audio, video or any other data or communications you create / post / input in to the website.
Content that you provide includes all forum postings, survey results, comments, status updates and similar.
Content created by you still belongs to you and therefore you are free to use it online & offline. Any content created by other users or third parties on izwe is owned by them and therefore cannot be used by you unless they permit you to do so.
Izwe needs to use the content you create in order to provide its service (and actually make our website work). Posting content on the website means you are granting izwe a royalty-free, irrevocable, perpetual, worldwide, non-exclusive licence (with the right to sublicense) to use, reproduce, distribute, create derivatives works from, edit, translate or perform or display the content both on the website and within works in any form, media or technology that now exists or may be developed in the future. You also grant us the right to grant sublicenses of these rights to third parties.
Note: This sounds like a lot but is standard across the web and we promise to be responsible with everything you choose to create on the izwe website.
By posting content to the website you are stating that you have the right to post that content and to grant izwe the above rights. If other people believe that you have infringed their intellectual property rights they may challenge you via the Abuse Process. You must comply with the procedures set out in the Abuse Process.
You are responsible for the content that you post on the izwe platform and you must stick to the rules outlined in the Community Guidelines. You must not:
- post (in any way) information that is unlawful in the UK or in the country you reside
- post information you have no right to transmit
- post any material designed to interrupt, destroy or limit the functionality of the site, computer software, hardware or anything (no viruses thanks)
- post unsolicited or unauthorised advertising, chain letters, phishing emails or pyramid schemes
- collect information about other individuals
- attempt to affect adversely the validity of any izwe service through any means (e.g. multiple voting)>/li>

Intellectual Property in the Izwe platform and services
We hope to open up our application programming interfaces (API's) and as soon as we do we'll update our terms. This will allow developers to do even more interesting things with the content on the website.
izwe owns the website as a whole and all elements are copyrighted works of izwe. This includes but is not limited to: computer code, design, graphics, user interface, interactive features. These and other aspects may be protected by intellectual property laws including trademark and trade secrets.
Except in ways set out in these terms you may not modify, copy, reproduce, create derivative works or distribute in any way content on the izwe platform that does not belong to you without the prior consent of izwe.

The Content of Others
izwe does not pre-moderate or control the content posted on the website by other users and does not guarantee the integrity, quality or accuracy of such content, and therefore has no liability in respect to the content of users.
By using izwe you may be exposed to content created by third parties that you find offensive, indecent, inaccurate or objectionable and agree that izwe will not be liable for such content.
We are working on moderation tools to allow you to flag this content and streamline the removal of such content.
If you believe that any such content infringes your intellectual property rights or is otherwise against our Community Guidelines then take a look at the Abuse process for instructions as to what to do.

Links, Streaming & Third Party Websites
As with any other website us, our partners and users may link out to interesting things elsewhere around the web. izwe does not own these websites therefore we are not responsible or liable for any content on these sites or that may be added to them later. The izwe community are also likely to make use of streaming and embedding from external website services (e.g. YouTube) within the izwe platform and we cannot be held accountable for any updates to these streams.
Inclusion of links does not imply endorsement by izwe or an association with the author or site operators.

RSS Feeds
We use RSS feeds to make some of our content available via other website, mobile and desktop applications. We make these available on the understanding they are used by personal non-commercial use, you link back to us as the source of the content, the feed is not used to imply our support of any third party and the feed does not overload our servers.

izwe may still use some of the content you have created on the site even if you stop using the website.
Don't hold us responsible for things you or others do on the site.

This is just common sense, we can't guarantee there won't be disruptions to the service or that some people won't use the website to do things we'd rather they didn't. But we can try our best to give you the tools to police it, tell you what's going on and to build in systems to stop it happening. If you think we should improve these tools and you have ideas as to 'how', please let us know.
Warranty, waivers and "As Is"
We do not guarantee in any way that izwe will remain as it is nor will be available at any particular time.
Nothing in our content constitutes advice of any sort. You should not rely on any information that you find on our website without externally verifying it with a reliable third-party source.
All our content is provided on an as-is basis. To the maximum extent allowed by law, we do not give any representation, warranty or undertaking of any kind in respect of our website or any of our content including, without limitation, any warranty of satisfactory quality, conformity, accuracy, adequacy or fitness for any particular purposes.
In our site and through our community you may well interact with other people. We are not liable for any harm you might come to nor damage you may suffer as a result of such interaction.

Indemnity
You shall indemnify us and hold us, our data providers, our partners and our sponsors harmless against all costs, damages, expenses (including, without limitation, legal expenses), loss and liabilities that arise as a direct or indirect result of any breach of these terms by you, your fault, your negligence or breach of statutory duty.

Exclusions of liability
You agree that we are not liable to you for any loss (of whatsoever nature) that you may suffer as a result of your access and use of our site. However this shall not extend so as to exclude any liability it is not lawful to exclude (either now or in the future).

Misc
We operate under English law and these terms should be interpreted and governed in accordance with this law. Use of the izwe website means you consent to the exclusive jurisdiction of the English courts.
These terms, the izwe privacy policy, abuse process and community guidelines constitute the entire agreement between you and izwe and supersedes any prior agreements, arrangements, statements and understandings between izwe and you in this area.
If any of the terms specified here are found to be unenforceable or invalid this term shall be limited in the smallest way possible to ensure that the rest of these terms remain in effect to their full force.
The rights and remedies set out in these terms and conditions are cumulative and without prejudice to any other accrued rights and remedies, whether under contract, law or otherwise.
Save as set out in the indemnity, nothing in this agreement shall create any right for any third party pursuant to the Contracts (Rights of Third Parties) Act 1999.
The failure by izwe or you to exercise or enforce any of the rights provided in these terms does not indicate a waiver of the remaining rights.
